On Tuesday, April 2, Plantronics Inc. urged a Federal Circuit panel to revive a patent infringement suit against Aliph Inc., citing claim construction errors in a lower court decision regarding its earbud patents. In oral arguments, appeals judges said “they couldn’t see how Plantronics’ invention could be considered unpatentable in the eyes of the court.” Finnegan represented Plantronics in this matter.
