Erika Harmon Arner, chair of Finnegan and former managing partner, is a nationally recognized leader in trial practice before the Patent Trial and Appeal Board (PTAB) and related appeals to the U.S. Court of Appeals for the Federal Circuit. She consistently ranks as one of the top three female attorneys appearing in PTAB trials and was named a PTAB Litigator of the Year by Managing Intellectual Property. She has argued and won a number of landmark cases at the PTAB and Federal Circuit for both patent challengers and patent owners.

Erika’s practice focuses on patent office trials, client counseling, and litigation, with an emphasis on electronic technology and computer software. She has represented patent owners and petitioners in more than 200 PTAB trials, most as lead counsel. Erika has also argued and won appeals from PTAB trials to the Federal Circuit, many of which involve issues of first impression. She has also successfully defended district court decisions on appeal at the Federal Circuit.

In addition to her extensive experience in patent office and appellate practice, Erika is a well-known authority in the area of patent-eligibility jurisprudence. Since representing the petitioners before the U.S. Supreme Court in Bilski v. Kappos, she has handled dozens of cases involving issues related to patentable subject matter before the Federal Circuit, U.S. district courts, and PTAB. Erika also advises clients on patent strategy and portfolio management.

Erika is a leader in the IP bar and a champion for women in IP. She co-founded the Washington, DC chapter of Women in IP Network (WIN), currently serves as a trustee of the Foundation for Advancement of Diversity in IP Law, and serves on the board of the Intellectual Property Owner’s Education Foundation (IPOEF). She is a frequent author and lecturer on computer-related patents, patent strategy, and PTAB practice. Erika is also a member of Managing IP’s Editorial Board.

Over her career, Erika has been recognized for her post-grant and patent litigation practices. The Legal 500 U.S. named her one of the leading lawyers in post-grant proceedings and inducted her into the patent prosecution Hall of Fame. She has also been named as a Global Leader as well as recognized for her practice in the DC region by Intellectual Asset Management and honored by Managing IP. For the past several years, she has been named by Managing IP as one of the “Top 250 Women in IP” as well as a “Patent Star” nationally and in Virginia. 

Erika previously served on the firm’s management committee and has led both the electrical and computer technology practice group and the patent office practice.

Represented petitioner SharkNinja in district court litigation and related inter partes reviews related to robot vacuum cleaner technology. Successfully cancelled all claims iRobot asserted in the district court litigation at the PTAB.

Google LLC f/k/a Google Inc. v. Ikorongo Technology LLC

Successfully represented petitioner Google in inter partes reviews (IPRs) involving a patent relating to media recommendations based on geographic location. After the initial petitions were denied institution on Fintiv grounds, Finnegan filed a request for rehearing, leading to both petitions being instituted. After oral argument, all challenged patent claims were found unpatentable and cancelled.

Google LLC v. Uniloc 2017 LLC

Represented Google as petitioner in an inter partes (IPR) review at the Patent Trial and Appeal Board (PTAB), successfully cancelling all challenged claims related to natural language processing and information retrieval. On subsequent appeal, successfully represented Google before the Federal Circuit, securing affirmance of the PTAB’s decision.

ClearOne, Inc. v. Shure Acquisition Holdings, Inc.

Represented appellees Shure Acquisition Holdings, Inc. and Shure Incorporated in an appeal from the Patent Trial and Appeal Board (PTAB). In a precedential decision, the Federal Circuit unanimously upheld the validity of Shure’s substitute claims and rejected ClearOne’s procedural challenges to the Board’s ruling. The underlying inter partes review (IPR) was one of the first to utilize the Board’s Motion to Amend Pilot Program.
