Kara Specht focuses on patent litigation before U.S. district courts, the International Trade Commission (ITC), the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO), and the Court of Appeals for the Federal Circuit. She has been recognized by World Intellectual Property Review as a Trailblazer, and at the 2023 Women in Business Law Awards, which recognizes leading women practitioners from over 30 practice areas, she was shortlisted for the Intellectual Property Rising Stars award. Kara currently co-leads Finnegan's LGBTQ+ Affinity Group.

Kara's practice covers a wide range of electronic and electrical technology areas related to automotive, financial systems, global positioning systems (GPS), semiconductor devices, wireless communications, consumer electronics, and software/computer-implemented methods. She is well-versed in all aspects of patent litigation. Appearing before district courts and the ITC, Kara has experience from both a plaintiff and defendant perspective, ranging from pre-filing planning and strategy, discovery management, and motion practice to offensive and defensive depositions, claim construction, and summary judgment. Through seconding at a leading multi-national technology company, Kara has first-hand insight into corporate litigation procedures and the importance of considering the business impact in developing case strategy.

Kara has a command of inter partes review (IPR) proceedings before the PTAB. While she represents both petitioners and patent owners, Kara has particular proficiency in counseling petitioners, crafting strong invalidity challenges, and presenting them to the Board at oral argument. Beyond trial-level litigations, Kara is accomplished before the Federal Circuit, preparing appeal briefs and amicus briefs, and handling in particular appeals from the PTAB. She has argued successfully at the Federal Circuit on behalf of an appellee from a PTAB proceeding.

Giving back to the intellectual property and legal communities is a core commitment for Kara. She serves as chair of the Intellectual Property Section of the Atlanta Bar, co-chair of the PTAB Bar Association Trials Committee, and as an advisory committee member for the Pro Bono Partnership of Atlanta.

Experience

Stragent, LLC v. BMW et al.

Obtained a royalty-free license to Stragent’s entire patent portfolio after forcing Stragent to concede in open court that it could not present enough evidence to prove infringement of its asserted patents, which Stragent read on the automotive communications standard AUTOSAR. Successfully invalidated multiple of Stragent’s patents before the Patent Office, with one victory on appeal and additional IPR petitions pending at the time of case resolution.

In the Matter of Certain Semiconductor Devices and Products Containing the Same

Achieved a comprehensive victory for respondent Innoscience, a global leader in gallium nitride (GaN) power devices, in a high-profile patent dispute before the U.S. International Trade Commission (ITC). The ITC’s Final Determination confirms that Innoscience avoided all patent claims asserted by Infineon.

BMW of North America, LLC and Bayerische Motoren Werke AG v. Arigna Technology Ltd.

Secured a covenant-not-to-sue and zero-dollar walkaway for BMW Group in a declaratory judgment action, concluding Arigna’s high-profile patent enforcement campaign involving current amplification technology. This outcome follows a decisive ITC victory, the dismissal of parallel District Court litigation, and multiple concurrent patent office challenges pending at the time of resolution.

NorthStar Systems LLC v. BMW et al.

Secured a royalty-free covenant not to sue from NorthStar for its present and future patent portfolio, which includes patents related to displaying navigation information on electronic maps, mobile devices selectively reporting GPS position information to others, and route-based communication planning architecture and wireless communication. This result was achieved after filing a declaratory judgement as well as IPRs on all claims of all asserted patents, leading to favorable institution decisions.

Liberty Access Technologies Licensing LLC v. ASSA ABLOY AB et al.

Represented ASSA ABLOY in a patent litigation in the Eastern District of Texas against NPE Liberty Access, who asserted three patents directed to using smart phones to unlock doors in hotels. Finnegan filed IPRs for each of the asserted patents, and obtained a favorable dismissal before the IPR institution deadline.
