Managing Privilege in the Context of Due Diligence

  • Do the respective parties in a business deal have a shared privilege?
  • If so, when does the shared privilege come into existence?
  • When does it end?
  • What activities can cause a waiver of privilege in this context?
  • How can your privileges best be protected?
  • Are written agreements required?
