Advanced IP Workshop—How Chinese Companies Effectively Handle and Deter NPE Litigation

Co-hosted by the Shenzhen Patent Association, the program features Finnegan attorneys Lionel Lavenue and Linda Thayer who will discuss how Chinese companies can effectively handle and deter litigation brought by a non-practicing entity (NPE).

NPEs continue to dominate the patent infringement landscape in the United States, particularly for Chinese companies. Please join us for a discussion of the latest strategies (both in the courts and before the U.S. Patent and Trademark Office) to defeat claims of patent infringement by NPEs in the United States, as well as a review of the recent proposals for patent reform.

Topics include:

  • Tips and techniques for winning as a defendant in the U.S. District Court for the Eastern District of Texas (E.D. Tex.), especially as a defendant located in Asia, and the use of special procedures to level the playing field for litigation in this particular court
  • Motions to dismiss based on patent-ineligible subject matter, and how courts have addressed such motions since the U.S. Supreme Court’s Alice decision
  • How to prepare an effective petition for inter partes review (IPR) and post-grant review of covered business method patents (CBM)
  • Real-party-in-interest: Who must be named in the petition?
  • Patent litigation reform: What is being discussed and what may actually be enacted?

Finally, case studies showing how Chinese companies can effectively use IPR to settle NPE cases will be discussed. Please join us for this important discussion.
