The U.S. Patent and Trademark Office (USPTO) has come forward to support i4i LP in it’s battle with Microsoft over the standard that defines a patent as “invalid.” Microsoft is arguing that a patent should be declared invalid based on “preponderance of evidence” versus the current definition of “clear and convincing evidence.” The USPTO submitted a brief that states a “ruling in Microsoft’s favor would diminish the value of patents,” according to Law 360
