On Thursday, February 21, Under Armour filed suit in Maryland federal court accusing Nike of infringement of Under Armour’s “I Will” trademark. Nike is accused of unlawful use of the “I Will” tagline that is a cornerstone symbol of the Under Armour brand. The suit “seeks damages and an injunction that would prevent Nike from continuing to use the phrase or a substantially similar slogan.” An Under Armour spokeswoman said, “We prefer to battle our competitors in the marketplace and on the field of play with our game-changing innovative products, but we will defend ourselves whenever necessary to protect what we’ve worked so hard to build. We will not allow a competitor to blatantly infringe upon our established trademark rights.” Under Armour is represented in this matter by Finnegan.
