While many consider the America Invents Act as much needed reform to the U.S. patent system, others have expressed concerns that phased implementation of the new law will undoubtedly add some confusion to the system. David S. Forman, Ph.D., senior counsel at Finnegan, states in relation to the implementation of a first-to-file system, “For some five to six years, the patent law will be schizophrenic, with new applications judged under new rules after March 2013, but older pending applications judged under the old law.” Additionally he states, ”During the long period of transition there will be incredible complexity.”
