Janina Wortmann advises companies on German and EU trademark and design law and represents them in related litigation, with a focus on preliminary injunction proceedings. She handles unfair competition/advertising law, copyright and domain matters and counsels clients on selective distribution systems. Janina’s industry focus is on consumer goods, particularly cosmetics, fashion, and food, as well as pharmaceuticals.
With over 13 years of experience, Janina is an authority on all aspects of “non-technical” intellectual property law. She provides counsel on the entire life cycle of German and EU trademarks and designs (registered and unregistered), including building and defending trademark and design portfolios, and representation in related litigation before the German and European IP offices and German civil courts. Janina’s counterfeiting and gray market goods practice includes assisting clients in border seizure proceedings. She also drafts and negotiates all types of trademark and design-related agreements, such as delimitation or license agreements.
Janina has experience in a variety of unfair competition law matters. She provides advice on online and offline advertising campaigns (including misleading advertising, comparative advertising, green claims, etc.), product imitation cases under unfair competition law, and she represents clients in related litigation before German courts. Additionally, Janina advises clients on regulatory aspects that constitute a market conduct rule and can as such lead to claims under German unfair competition law (for instance textile labelling law, price indication law, cosmetics law, or the law on health claims).
Janina represents clients in domain disputes both before the courts and in UDRP proceedings. She also advises on copyright law issues, such as whether utility objects constitute works of applied art that are protected by copyright.
