Abhinav Garg, a patent litigator and counselor, represents clients in U.S. district courts and in Section 337 investigations before the U.S. International Trade Commission (ITC). He also advises on matters related to freedom to operate (FTO), enforcement, and risk mitigation. Abhinav works across a broad range of technologies, including polymers and advanced materials; lithium-ion and next generation batteries; chemical and refrigeration systems; pharmaceutical drugs; electric bikes; and aeronautics. Abhinav applies his background as a medical adhesive/process engineer and as a patent examiner with the U.S. Patent and Trademark Office (USPTO) (Art Unit 1776, gas separation) to give him practical insight into product development, prior art, and validity.
Across litigations, Abhinav has developed infringement and validity contentions; managed fact and expert discovery; prepared and examined fact and expert witnesses; crafted claim construction positions; and supported pre trial and trial strategies. His matters include ITC Section 337 investigations involving advanced polymeric materials, Hatch Waxman pharmaceutical disputes, and district court cases spanning materials, filtration, textiles, and mechanical systems.
Abhinav counsels on cease and desist strategy and FTO, conducting rigorous technical deconstructions of products and processes, performing claim element mapping, building invalidity positions, and overseeing targeted manufacturing runs to substantiate prior use when appropriate. His counseling experience spans energy storage, industrial coatings, refrigerants, and micromobility. Abhinav also works with clients to develop their patent protection strategies, including drafting and prosecuting patent applications.
During law school, Abhinav served with Judge Jimmie V. Reyna of the U.S. Court of Appeals for the Federal Circuit and at the ITC’s Office of Unfair Import Investigations. He won first place at the national Giles S. Rich Memorial IP Moot Court Competition and contributed to the Federal Circuit Bar Journal.
Abhinav maintains an active pro bono practice, including leading a veteran’s discharge upgrade matter involving a filed brief before the Army Board for Correction of Military Records and extensive client communications.
