Privacy Policy for Job Applicants

Introduction

Finnegan, Henderson, Farabow, Garrett & Dunner, LLP (Finnegan) is committed to protecting the privacy and security of the personal information of job applicants. This privacy policy outlines the types of personal identifiable information (PII) Finnegan may collect from you during the job application and hiring process and how we use, store, and protect that information. Further, Finnegan is committed to complying with the California Consumer Privacy Act (“CCPA”), Massachusetts data security regulations (201 CMR 17.00 et seq., the “Massachusetts Regulations”), General Data Protection Regulation (“GDPR”), China’s “Regulations on Administration of Network Data Security,” and any other applicable local, state and/or federal laws related to data protections for job applicants.

When you apply for a job at Finnegan, we may collect and store the following types of PII:

  1. Contact Information: Your name, address, email address, and phone number.
  2. Identification Information: Date of birth, social security number, and other government-issued identification numbers.
  3. Employment History: Details of your previous employment, including job titles, responsibilities, and dates of employment.
  4. Educational Background: Information about your educational qualifications, including institutions attended, degrees obtained, and dates of attendance.
  5. Professional Qualifications: Certifications, licenses, and other professional qualifications.
  6. References: Contact information and details of your professional references.
  7. Resume/CV and Cover Letter: Information included in your resume/CV and cover letter, such as skills, experiences, and personal interests.
  8. Interview Notes: Notes and evaluations from interviews conducted by our hiring team.
  9. Background Check Information: Results of any background checks conducted with your consent, and subject to all applicable protections under the Fair Credit Reporting Act or other applicable laws.
  10. Voluntary: Self-disclosure regarding demographic data, veteran, and disability status.

How Your Information Is Collected

Finnegan collects most information directly from you.  We may validate information or supplement information you have provided to us from:

  1. Your former employers
  2. Your educational institution
  3. Credit reference agencies
  4. Additional third-parties, such as references, with your consent.

How We Use Your Information

We use the information collected from you to:

  • Evaluate your qualifications for employment.
  • Contact you regarding your application and potential employment opportunities.
  • Conduct background checks and verify your information.
  • Comply with legal and regulatory requirements.

We do not use data collected for employment for marketing or advertising purposes.  Third-party service providers that assist us in our employment-related document processing and storage may not use or disclose data except in fulfillment of their contractual obligations to Finnegan.

Data Storage and Security

We take the security of your personal information seriously. Your data will be stored securely on our systems and will only be accessible to authorized personnel involved in the hiring process. Data submitted to Finnegan for employment purposes will be processed and stored in the United States.  Finnegan implements appropriate technical and organizational measures to protect your information from unauthorized access, disclosure, alteration, or destruction.

Data Retention

Finnegan will retain your personal information for as long as necessary to fulfill the purposes outlined in this privacy policy, unless a longer retention period is required or permitted by law.
