The dismantling of the unique first-to-invent patent system in the United States is arguably the most striking aspect of the America Invents Act (AIA). For decades, the world has been resigned to believe that harmonization of the patent laws of the United States, by implementing a first-to-file patent system, would never arrive. Well, the good news is that the first-to-invent patent system will no longer apply to applications filed on or after March 16, 2013. The bad news is that the United States still has not implemented a traditional first-to-file patent system.

The U.S. Patent and Trademark Office (USPTO) has issued many of the final rules governing how it will implement the procedures governing this significant change. This webinar will discuss these procedures and how you and your clients’ practices in the United States will need to adapt. Topics covered will include how the USPTO will determine what prior art is applicable to an application; which law and which corresponding rules will apply to applications straddling the March 2013 implementation date; and how the still-existent, but greatly diminished, grace period will be administered.
