Join Finnegan and Lee & Li for a seminar on December 19, discussing trade secret strategy and protection. According to the data published by the Ministry of Justice, in recent years, the investigation of newly collected cases in cases of violation of the Business Secrets Law is still showing an increasing trend year by year, but the chance of the right holder winning the case is low. Well-known domestic and foreign enterprises, including TSMC, MediaTek, Corning, VIA, Meiguang, etc., have been violated by business secrets and brought civil criminal relief. Enterprises have not fully grasped the requirements of business secret protection, in the case of business secret infringement, often because of the failure to prove that the business secrets meet the statutory requirements, resulting in the right cannot be remedies. The more complex the management measures, the higher the internal costs and the possible impact on operational efficiency. How to manage business secrets by the thinking of business model in order to increase competitiveness and manage future trends, and to establish reasonable and efficient management measures recognized by judicial practice, is the first theme of this seminar.

On the other hand, China's intelligent property case trial law implements the "secret maintenance order" system to protect the business secrets held by the parties or third parties, and the evidence and attack and defense of business secret litigation have special characteristics. Once the court has ruled that the "secret hold order" restricts the parties concerned from accessing the litigation data, it is highly likely that the litigation agent will have to complete the task independently. The second theme of this seminar, which is shared by Taiwan and the United States in contrast to judicial practice, will enable enterprises to understand and conduct evidence of business secret litigation under the "Secret Maintenance Order."
