Non-practicing entity (“NPE”) patent cases can impose significant litigation costs for a defendant. This webinar will discuss practical strategies for seeking early resolution through Rule 12 motions based on patent eligibility under 35 U.S.C. § 101 and the Alice/Mayo framework. The speakers will also address how defendants can pursue exceptional case findings and attorney fee awards under 35 U.S.C. § 285 after obtaining a judgment of invalidity.

Topics to be discussed include:

  • When Alice motions may be an effective tool for resolving NPE patent cases at the pleading stage
  • Key considerations for framing patent eligibility arguments under the Alice/Mayo two-step framework
  • Strategies for pursuing exceptional case findings and attorney fee awards under 35 U.S.C. § 285 following a successful invalidity judgment
