Life Sciences Workshop: Updates and Recent Trends in Pharmaceutical and Biotechnology Patent Law

This workshop addresses the ability to appeal an adverse decision from U.S. Patent and Trademark Office (USPTO) proceedings, the latest significant decisions from the Patent Trial and Appeal Board (PTAB), venue selection for litigation, and the impact of “blocking patents” on objective indicia of non-obviousness. Life sciences patent practitioners have a multitude of factors to consider in protecting their own portfolios and evaluating the portfolios of others. Please join us as we address these issues and provide insight to help guide your practice, including:

  • Recent trends concerning Article III standing requirements in Federal Circuit appeals from USPTO proceedings, including the Supreme Court’s request for briefing from the Solicitor General in deciding whether to grant certiorari in RPX Corp. v. Chanbond LLC
  • Recent updates in post-grant proceedings
  • Tracking the application of the Supreme Court’s TC Heartland decision by district courts and other venue considerations for pharmaceutical patent infringement cases
  • Recent decisions on the impact of “blocking patents"
