The past year has fundamentally reshaped post-grant practice before the Patent Trial and Appeal Board (PTAB) and Central Reexamination Unit (CRU) of the U.S. Patent and Trademark Office (USPTO). New procedures governing institution decisions and reexamination orders, evolving discretionary denial standards, and increasing Director involvement before and after institution decisions have changed the landscape for both patent owners and petitioners.

This webinar is the first installment in our two-part series examining recent developments at the PTAB and CRU and their practical implications for patent litigation. Join us for an in-depth discussion of the most significant PTAB and CRU developments from the past year and the practical implications for companies navigating post-grant challenges.

Our panel will examine how recent policy changes and decisions are affecting filing strategies, institution outcomes, reexamination orders, and the overall effectiveness of post-grant challenges at the USPTO. We will also provide insights into emerging trends and considerations that may influence practice in the months ahead.

Topics to be discussed include:

  • Recent USPTO guidance affecting PTAB proceedings
  • The evolving role of discretionary denials in both PTAB and CRU practice
  • Director review and changes to PTAB decision-making processes
  • Significant PTAB and Federal Circuit decisions from the past year
  • Current trends affecting IPR and PGR strategy, including the filing of EPRs
  • Practical considerations for patent owners and petitioners in an evolving environment
