In this webinar, we will be reviewing the key EU and UK trademark cases over the last 12 months as well as discussing their take-home messages and relevance in practice.

Cases to be discussed include:

  • The Brompton Bike case reveals that copyright protection can cover designs that are dictated by their technical function under certain conditions (SI, Brompton Bicycle Ltd v Chedech/Get2Get, C-833/18 11 June 2020)
  • Louis Vuitton’s chequerboard pattern trade mark was found invalid in the EU (Louis Vuitton Malletier v EUIPO, Case T 105/19 10 June 2020)
  • The Court of the Hague found in favor of Impossible Foods, finding that Nestlé had infringed the IMPOSSIBLE BURGER trade mark in the EU (Impossible Foods v Nestlé, Court of The Hague, IEF 19227, 27 May 2020)
  • Ferrari’s EU trade mark registration for the shape of the 250 GTO Ferra was partially cancelled by Ares Performance AG (Ares Performance AG v Ferrari SpA, Cancellation Division, EUIPO July 2020)
  • The CJEU examined whether the shape of an Oreo is distinctive in the EU (Galletas Gullón v EUIPO - Intercontinental Great Brands (gullón TWINS COOKIE SANDWICH), T-677/18 28 May 2020)
  • The Italian Consortium for the Protection of the Controlled Designation of Origin Prosecco successfully opposed a UK trade mark application for NOSECCO based on their Protected Designation of Origin in the Prosecco name (Italian Consorzio di Tutela della Denominazione di Origine Controllata Prosecco v Les Grands Chais De France, O/691/19, Opposition No. 413693)
