IPR and PGR Fees to Increase on

Summary

The USPTO will be increasing its minimum fees for IPRs and PGRs effective October 2, 2020, while also increasing the number of claims covered by the minimum fees.  Highlights of the fee increase are provided below.  For more details see the USPTO’s Summary of FY 2020 Final Patent Fee Rule.

IPR:  minimum fees will increase to $41,500

  • Request will now cover up to 20 claims instead of only 15 claims, and fee will increase from $15,500 to $19,000; fee for each additional claim will increase from $300 to $375.
  • Post-institution fee will increase from $15,000 to $22,500; fee for each additional claim will increase from $600 to $750.

PGR:  minimum fees will increase to $47,500

  • Request will now cover up to 20 claims instead of only 15 claims, and fee will increase from $16,000 to $20,000; fee for each additional claim will increase from $375 to $475.
  • Post-institution fee will increase from $22,000 to $27,500; fee for each additional claim will increase from $825 to $1,050.
