The United States Patent and Trademark Office (USPTO) has announced substantial updates to its patent fee schedule, including adjustments to 433 existing fees and the introduction of 52 new ones. Among the most impactful changes are new fees for continuing applications that claim priority to filings over six or nine years old, as well as a tiered fee structure for Information Disclosure Statements (IDS) based on the number of items submitted. Core fees for filing, examination, excess claims, and Requests for Continued Examination (RCE) have also increased, along with targeted updates to provisional application extensions, terminal disclaimers, patent term extensions, and AIA trial proceedings. While many of these changes reflect inflation and cost recovery, they also introduce new procedural requirements and strategic considerations for applicants and practitioners navigating the patent system.
