On Thursday, April 26, Under Armour filed a trademark infringement suit in Maryland federal court accusing Body Armor, a sports drink maker, of “labeling its beverages with a name and logo that intended to deceive customers into believing the products fall under the Under Armour brand.” The suit stated that, Body Armor “has shrouded its sports beverage with these hallmarks of Under Armour branding. As a result, consumers are likely to believe defendant’s drink is made by Under Armour or approved or licensed by Under Armour.” The suit filed by Under Armour “seeks an order declaring that the Body Armor name, logo, and slogan, as well as its website, infringe and dilute Under Armour’s trademark holdings, along with damages and an injunction preventing the drink maker from continued use of the marks.” Under Armour is represented by Finnegan in this matter.
