Tennis Racket Buyers Denied Cert. in False Ad Row

On March 8, 2016, a California federal judge declined to certify a class of tennis enthusiasts, led by Russell Minoru Ono, who claimed that Finnegan client Head Racquet Sports mislead consumers into believing that the tennis rackets sold in stores are identical to those used by top athletes like Roger Federer, Andy Murray, and Maria Sharapova in competition play. Ono had sought to certify a class of California consumers who had bought a racket from Head's Tour Line since 2006. He alleged violations of the California Consumers Legal Remedies Act and the state’s unfair business practices and false advertising laws. However, the judge ruled that given the nature of the advertising media used by Head, Ono had failed to show that even a majority of the proposed class members were exposed to Head's allegedly deceptive advertising.
