Should the Federal Circuit Stop Issuing Rule 36 Affirmances?

March 3, 2017

Managing Intellectual Property

In its article discussing Federal Circuit Rule 36 affirmances of Patent Trial and Appeal Board (PTAB) appeals, Managing Intellectual Property cited Finnegan's AIA Blog.

The article addresses law professor Dennis Crouch's call for the Federal Circuit to sop issuing Rule 36 decisions and instead issue an opinion. According to Finnegan's AIA Blog, as of February 1, 2017, the Federal Circuit has issued Rule 36 decisions in 54 percent of inter partes review and covered business method review appeals.
