ITC Hands Mitsubishi Win in GE Wind Turbine Case

The U.S. International Trade Commission has reversed an administrative law judge’s ruling and terminated a Section 337 complaint filed by General Electric Co. against Mitsubishi Heavy Industries Ltd., finding no violation of GE patents by Mitsubishi wind turbine components. GE had accused Tokyo-based Mitsubishi and its subsidiaries of importing turbine parts that infringed three patents. After the administrative law judge’s ruling, an ITC investigative attorney questioned particular findings on patent-specific claims; based on the conflicting reports, the full commission agreed to review the ALJ’s initial determination. Mitsubishi is represented by Finnegan.
