Harley Notches Win in 7th Circ. Trademark Row with Licensee

September 5, 2012

Law360

On Wednesday, September 5, the Seventh Circuit “upheld a Wisconsin district court’s temporary restraining order and injunction against a former Harley-Davidson Motor Co. merchandise licensee in Greece that the motorcycle giant has accused of manufacturing apparel it did not approve.” The panel stated, “Harley-Davidson made strong showings that [Hellenic] was deliberately breaching a binding trademark licensing agreement. Since Harley-Davidson learned of the breaches and terminated the parties’ licensing agreement, [Hellenic] has tried numerous legal twists and contortions to try to avoid the legal consequences of its actions.” Finnegan represented Harley-Davidson in this matter.
