In a roundtable discussion on cybersecurity, which took place in Israel, Finnegan attorney Jeffrey A. Berkowitz commented on the importance of new and established companies in the field developing a patent strategy. He noted that this requires an expert analysis of the company’s business and focusing patent protection on blocking would-be competitors from the business revenue stream. Berkowitz also explained that developing standards in the field may be problematic because, as we’ve seen in other fields like telecommunications, some patent-savvy companies will develop special programs to obtain patents covering features included in standards and later exploit these patents to obtain revenue from other companies who use the standard in their technology.
