Firms Claim Bragging Rights in New Field of Patent Litigation

In a review of Patent Trial and Appeal Board (PTAB) inter partes review (IPR) statistics, Finnegan was identified by The Recorder, an ALM Media publication, as one of the top firms submitting IPR petitions that have met preliminary approval for institution 95 percent of the time or more. In addition to the firm’s success rate for petitioners, Finnegan has blocked “nearly 50 percent of proceedings when representing patent owners.” The Recorder contacted Finnegan partner, Erika H. Arner, chair of the firm’s patent office practice, to weigh in on the firm’s success in representing both petitioners and patent owners. Arner states that the favorable results for clients are “not an accident…most Finnegan attorneys have practiced both patent prosecution and litigation, positioning them well for PTAB proceedings,” noting that “nearly all Finnegan attorneys have done both or do both.”
