On July 3, the Federal Circuit ruled in favor of Finnegan client PPC Broadband, reversing the Patent Trial and Appeal Board's (PTAB) decision which invalidated claims in three PPC Broadband patents. The court found that for the second time, the PTAB failed to acknowledge claims involving "electrical continuity" implied constant contact between two components, and they failed to recognize PPC’s SignalTight product’s commercial success as a defense against obviousness.
