On Monday, the Federal Circuit found invalid Novozymes A/S’s patent covering an enzyme used to make ethanol. The ruling in favor of DuPont’s Danisco A/S affirms a lower court determination, which also found U.S. Patent Number 7,713,723 invalid “because its written description did not meet the requirement set out under U.S. law.” Finnegan represented DuPont in this matter.
