In 2025, the U.S. Patent and Trademark Office introduced restrictions on inter partes review proceedings for assessments of patent validity. In a conversation with Law360, Daniel Tucker Finnegan partner and co-leader of the firm’s appellate section, said those restrictions attracted “all sorts of constitutional challenges regarding the office's new practices and procedures for determining whether to institute these proceedings.”
