San Jose-based Monolithic Power Systems has won battles on two separate fronts against rival O2Micro International Ltd., which tried unsuccessfully to claim that its patents were infringed in multiple legal wrangles. U.S. District Judge Claudia Wilken agreed Wednesday to O2’s motion to dismiss its patent infringement claim less than a month before it was scheduled to go to trial in Oakland and a few days after the U.S. International Trade Commission concluded that Monolithic Power Systems did not infringe its patent. Now, Monolithic’s attorneys plan to seek millions in attorney’s fees. Wilken has given defense lawyers two weeks to file a motion for attorney’s fees. Scott Mosko, a partner at Finnegan’s Palo Alto office, represents the other defendant in the case, ASUSTek Computer Inc., a computer manufacturer that buys Monolithic chips.
