Corporations are having to grapple with the changing landscape of privacy law and security mandates. More often than not, they are drafting lengthy privacy notices that don’t match up to their actual practices.
As more states have passed and are passing their own privacy regulations, attorneys speculate that the nuances will only get worse before they get any better.
Finnegan partner Lynn Parker Dupree told Corporate Counsel that the problem may be that some organizations aiming to build compliance strategies that align with these laws and regulations may be biting off more than they can chew.
“It takes a mature organization to have processes that require a product developer or a marketer to always check in with their privacy team before they move ahead or checking with their privacy counsel or get an outside opinion. That’s something that you only really see at super, super mature organizations that you don’t have any mistakes,” said Lynn.
She added that, “I think what the increase of laws is doing is forcing companies to recognize that privacy cannot be an afterthought. It might be worse before it gets better.”
