On October 10, 2019, the Federal Circuit upheld a Trademark Trial and Appeal Board (TTAB) decision that since Brazilian beverage company Cervejaria Petropolis had not used its FUSION mark for three consecutive years, the mark should be canceled. The decision allows Ambev to sell its Fusion energy drink in the United States.
