On December 12, 2017 the Ninth Circuit ruled in favor of Finnegan client Subaru, affirming a lower court ruling that Subaru's "Share the Love" phrase and accompanying design did not infringe Marilyn Mintz's trademarked phrase "A World of Love, for You and Those You Love" and "Heart on Hand" symbol. The panel found that the two phrases and marks were not similar enough to cause confusion, especially since the marks are used in connection with completely unrelated goods. The panel also rejected Mintz's copyright infringement claims and federal unfair competition claims.
