Law360 interviewed Finnegan partner Trenton Ward for an article reflecting on five critical developments at the Patent Trial and Appeal Board (PTAB) in 2020.
Trenton commented on the cases involving PTAB decisions the U.S. Supreme Court has taken on, including Arthrex, which questions whether the way PTAB judges are appointed is unconstitutional. Trenton, a former PTAB administrative patent judge, said the Arthrex decision is a larger agency question with farther reach. He said, “[Arthrex] is going to have bigger implications because so many agencies have administrative judges.”
