Bei einstweiligen Verfügungen wegen einer (vermeintlichen) Patentverletzung steht das Risiko im Raum, dass kurzfristig das eigene Produkt vom Markt genommen werden muss. Oder eben die Chance, einen Konkurrenten zu stoppen, der das eigene Patent verletzt. Ein Urteil des Europäischen Gerichtshofs (EuGH) führt dazu, dass nun viel mehr Patente als Basis für eine einstweilige Verfügung in Frage kommen – zumindest theoretisch.
