Daniel Tucker, co-leader of Finnegan’s Appeals, Issues, and Legal Strategy Section, focuses his practice on the interplay among district court patent litigation, PTAB post-grant proceedings, and Federal Circuit appeals. He has represented clients across a broad range of technologies, including wireless/cellular communications, semiconductor technology, consumer electronics, and internet services.
Having litigated numerous patent infringement cases from filing to resolution, Dan has developed and executed successful strategies for both patent owners and accused infringers. He has experience in all stages of litigation, including pre-filing investigations; taking and defending depositions; drafting dispositive motions and claim construction briefs; working with experts to prepare expert reports; and arguing in court, including claim construction hearings. Dan also has significant experience advising clients on the strategic implications of PTAB proceedings on pending district court actions.
Dan has litigated dozens of post-grant proceedings before the PTAB, including IPRs, CBMs, and PGRs, on behalf of both petitioners and patent owners. A high percentage of the patents involved in these proceedings have also been asserted in co-pending district court actions. In several of these proceedings, Dan served as primary arguing counsel during the PTAB trial. Dan has also appeared in several appeals from PTAB decisions to the Federal Circuit, including preparing numerous briefs in those cases. Dan has been recognized as a Rising Star by Managing Intellectual Property (MIP) magazine.
Before joining Finnegan and for his first two years at the firm, Dan also had an active prosecution and counseling practice, preparing and prosecuting patent applications before the USPTO in a wide range of areas, including computer software, display devices, wireless communications, control systems, industrial manufacturing, and Internet services.
Dan gained technical experience working as an engineer for General Electric in the transportation industry, and for Lockheed Martin in the aerospace industry.
