Kai Rajan has more than fifteen years of experience in intellectual property. He focuses his practice on patent portfolio development, patent litigation, and post-grant proceedings, in a broad range of technologies.
Kai practices patent litigation and prosecution for a wide range of clients, from startups to established companies. His patent prosecution practice focuses on developing patent portfolios in a broad range of computer, mechanical, and electrical technologies. He develops portfolios with multiple types of intellectual property protection including utility patents, design patents, trademark, and copyright. He also focuses on the IP issues of emerging technologies such as additive manufacturing, also known as 3D printing.
Kai’s litigation experience includes motions and briefing practice. He develops patent litigation strategies that leverage the benefits of recent patent reform in courts and in the U.S. Patent and Trademark Office (USPTO), such as inter partes review (IPR) and covered business method (CBM) petitions, and pre-issuance submissions.
Prior to joining Finnegan, Kai gained six years of experience as a patent examiner at the USPTO, where he negotiated patentable subject matter for mechanical, electrical, business method, and software technologies in the healthcare fields. He served as the lead examiner of his examination group for approximately two years, examining patent applications directed to a diverse array of fields including health and fitness tracking systems, body-worn smart medical devices, networked sensor systems, wireless data transmission, computerized medical diagnostic devices and systems, medical diagnostic device user interfaces, hospital patient and equipment management, healthcare personnel management, ambulatory patient monitoring and emergency response systems, ambulatory and hospital patient location medical record management, medical record analysis and data mining, healthcare and diagnostic mobile applications (apps), movement recognition systems, data visualization, and business methods directed to health and fitness.
Carrum Technologies, LLC v. BMW of North America, LLC, et al.
Obtained complete victory against Carrum on appeal of the District of Delaware’s claim construction to the Federal Circuit following Carrum’s stipulation of non-infringement under the claim construction, thereby exonerating BMW’s ACC system, first sold in 2000, against Carrum’s 2004 patents. Invalidated several asserted claims through post-grant efforts before the U.S. Patent Office, including IPRs and EPRs, and pursued claims through proceedings before the Eastern District of Virginia to vindicate BMW’s patent challenges.
