While several recent Federal Circuit opinions have clarified the law governing reasonable royalty damages, they have also left practitioners and district courts with a host of new challenges. Our panelists will discuss the Federal Circuit’s recent guidance on the entire market value rule, apportionment, and comparability. Topics include:

  • What is required before a damages expert may testify about drivers of demand? Are consumer surveys required?
  • What is the role of the technical expert in supporting a damages expert?
  • How can a damages expert safely “start” the analysis? Is any starting point or baseline just as vulnerable as the 25% Rule?
  • How can an expert use license agreements?
  • What is the effect of a patentee’s FRAND obligations?
  • What are the consequences when a reasonable royalty opinion fails to survive a Daubert or in limine challenge?
