Enforcing Patents in the U.S.: The State of Damages Law in Patent Cases

On December 22, 2009, a unanimous panel of the United States Court Appeals for the Federal Circuit affirmed a judgment of willful infringement against Microsoft and an award of nearly $300 million to a tiny Canadian software company called i4i. The Federal Circuit’s decision also affirmed a district court’s permanent injunction against Microsoft’s best-selling Word software. The i4i case is just the latest in a series of cases in which the Federal Circuit has addressed important damages issues for patent cases.

Presented by a member of i4i’s appellate team, this webinar:

- Examines the current state of damages law in the U.S., highlighting some of the current controversies being considered by the Federal Circuit and lawmakers.

- Includes case studies from several cases, including Lucent v. Gateway and i4i v. Microsoft, to illustrate different approaches to proving damages and how the courts have reacted to them.
