After much anticipation, the new first-inventor-to-file (FITF) system in the United States is finally upon us. Now what? Patent practitioners will need to learn how to navigate and succeed in a U.S. patent system having two sets of rules depending on an application’s effective filing date. And, for applications examined under the new FITF system, there will be an expanded universe of prior art to consider, along with a more limited one-year grace period. New patent office procedures in the United States are also now available to challenge the validity of issued FITF patents.

Please join our panel as they discuss implications, practical tips, and strategies for succeeding in the face of the U.S. Patent and Trademark Office’s final practice rules implementing the new FITF system. Topics will include:

  • Determining the “old law”/ “new law” status of an application, and steps to make certain that “old laws” continue to apply, where desired
  • Notification requirements for “transition applications”
  • Considerations in view of expanded prior art
  • Monitoring publications/disclosures of others for evidence of derivation
  • Strategic use of new USPTO post-grant proceedings
