After much anticipation, the new first-inventor-to-file (FITF) system in the United States is finally upon us. Now what? Patent practitioners will need to learn how to navigate and succeed in a U.S. patent system having two sets of rules depending on an application’s effective filing date. And, for applications examined under the new FITF system, there will be an expanded universe of prior art to consider, along with a more limited one-year grace period. New patent office procedures in the United States are also now available to challenge the validity of issued FITF patents.
