Since the 2007 Supreme Court decision in KSR v. Teleflex, U.S. patent applicants have faced increasing difficulties in overcoming obviousness rejections at the Patent Office. Numerous appellate decisions, however, have further refined the criteria for establishing and rebutting a prima facie case of obviousness during patent prosecution. Understanding and utilizing these decisions is critical to obtain effective prosecution. Further prosecution tools such as post-filing evidence can also be employed to maximize the prosecution process.

Please join us as we discuss practical tips and strategies to overcome obviousness rejections and submit persuasive post-filing evidence. Topics will include:

• Understanding an obviousness rejection and its supporting rationale

• Strategies and arguments for overcoming obviousness rejections

• Practical use of post-filing evidence with an eye toward subsequent enforcement
