Realigning Patent Prosecution and Litigation Strategies to Take Advantage of Recent Legislative and Judicial Changes

The America Invents Act (AIA), recent court decisions, and the complexities and nuances of the innovations themselves are changing how we obtain and litigate patents. This seminar is designed for in-house patent practitioners who are familiar with the basic requirements of U.S. patent law, and discusses practical implications of the changing patent laws and regulations, and strategies to take advantage of the new changes.

Our speakers will address the following topics:

  • Functional claiming strategies in view of recent case law—functional claim limitations and means-plus-function claims
  • Recent damages–related court decisions regarding the entire market value rule, FRAND licensing, the extraterritorial reach of U.S. patent law, and other significant developments affecting the value and risks of U.S. patent litigation.
