Much has happened over the past few months in the area of patent protection in the life sciences area. We are finally seeing implementation (or lack thereof) of the Biologics Price Competition and Innovation Act (BPCIA) provisions, an increased number of IPRs involving pharma and biotech patents, including challenges by hedge funds, and the Federal Circuit’s latest attempt to address joint infringement.
