  • Indefiniteness: How to draft or attack claims in view of cases considering Nautilus one year later, and recent Federal Circuit decisions on means-plus-function claiming
  • Risks and opportunities posed by extraterritoriality and foreign sales decisions, including the impact of the Federal Circuit’s recent decision in the Marvell case
  • International Trade Commission developments: (1) Impact of the en banc Suprema decision on allegations of induced infringement; and (2) Is intangible digital information subject to ITC jurisdiction? We will address opportunities and risks following the Federal Circuit oral argument in the Align case
  • Recent Patent Trial and Appeal Board developments, including the proposed new rules and PTAB decisions impacting indemnifiers, such as those addressing real-party-in-interest and privacy issues

The speakers will discuss the impact of recent developments and case law and how they present opportunities for strategically obtaining IP, strengthening portfolios, enforcing IP, and defending against assertions. They will offer guidance on navigating through recent changes in law and provide strategies on how those in the semiconductor and IC industry can thoughtfully address those challenges.
