Infringement, Invalidity, Freedom-to-Operate, and Patentability

Increasingly, companies must make business decisions based on the value of intangible assets. Successfully allocating research and development funds, conducting mergers and acquisitions, negotiating licenses, and evaluating the competition all depend on a company’s ability to understand the status of its own intellectual property (IP) and the IP portfolios of others. An IP due diligence is the study of intellectual property to gain access to information that helps to inform business decisions.

Due diligence projects come in many forms and can vary widely in complexity, scope and budget. This four-part seminar series will use practical examples and guide you through the due diligence process. Each session will build on the concepts from the previous session, resulting in a comprehensive overview of the diligence process, including how it can be used to bring value to your company and inform your business strategy.

In the second seminar of the Capturing Value series: A step-by-step seminar series on conducting an IP due diligence and identifying a portfolio’s potential, we will break down the most common assessment tools used during a due diligence. Working through exemplary business applications, you will understand how to identify the appropriate time to conduct each assessment, the strategy decisions involved, and what can be done with the search results. You will learn how to protect products and profits and manage business risks by using each of these tools to navigate a patent landscape.
