The America Invents Act (AIA) provides many new procedures to challenge patents, including post-grant review proceedings, inter partes review proceedings, and the transitional program for review of covered business method patents. Many of these procedures are being utilized quite often following their September 2012 implementation. Though new and uncertain, these procedures are now integral parts of the discussion in licensing, pre-litigation, and litigation strategies.
