The speakers will discuss recent developments in U.S. patent law and how they affect players in the semiconductor and IC industries, focusing on developments in the doctrines of extraterritoriality, induced infringement, and patent exhaustion. As courts apply and interpret the U.S. patent laws, they confront issues on what constitutes a “U.S. sale,” what a “design win” means legally and practically, what is required to “induce” infringement of a U.S. patent, and whether a sale of products overseas will exhaust a patent owner’s rights. The speakers will provide insight and strategic considerations for participants in the semiconductor and IC industries, from OEMs to IC design shops and foundries and beyond.
