The long awaited new USPTO Interim Guidance on Subject Matter Eligibility is finally here – But is another change on the horizon in view of the University of Utah Research v. Ambry Genetics decision?

The U.S. Patent and Trademark Office (USPTO) issued revised guidelines for the examination of claims reciting nature-based products. 

Please join our panelists for an interactive discussion on issues relating to:

  • How the new Interim Guidelines differ from the March 2014 Guidelines; 
  • What changes we should expect from the examining corps; 
  • How recent PTAB and federal court decisions in the biotechnology field affect the § 101 equation; and
  • Whether the Federal Circuit decision in the Ambry Genetics case can be rationalized with the Guidelines or will send the USPTO back to the drawing board.
