Duty of Disclosure: A Practical Guide to IDS Practice

The duty of disclosure is a unique requirement in the United States. Complying with the duty, however, can often be burdensome and complex, particularly when prosecuting multiple related patent applications before the USPTO. And failing to satisfy the duty can create the basis for an inequitable conduct allegation, one of the most commonly raised defenses in U.S. litigations.

This webinar will provide practical guidance on how to comply with the duty of disclosure. More specifically, we will present a detailed description of the formalities for disclosing information to the USPTO and outline suggested best practices for the various scenarios frequently encountered in U.S. prosecution.

This webinar is the first of four in our 2010 “Strategic U.S. Patent and Trademark Series for European Counsel.”
