The ITC: How to Use It Affirmatively

The International Trade Commission has become an increasingly popular forum for bringing patent infringement actions against importers of infringing products, due in part to the ITC’s expedited scheduling, the increased likelihood of proceeding to trial, and the potentially greater ease of obtaining injunctive relief as compared with U.S. district courts.  Litigating in the ITC, however, presents a unique set of challenges and companies must understand how to navigate the key substantive and procedural requirements imposed by Section 337 of the Tariff Act of 1930 and recent decisions of the ITC and the Federal Circuit.

Please join our panelists as they discuss:

  • Preparations for initiating a patent infringement investigation before the ITC, including making decisions regarding venue, seeking monetary and/or injunctive relief, assessing timing, and evaluating resources
  • Considerations for establishing the technical and economic prongs of the ITC’s domestic industry requirement
  • Potential pitfalls and other lessons from recent cases
